 These Terms & Conditions (“Terms”) govern your use of our website, www.shopmecha.com (the “Site”), and any purchase, order, or interaction with Mécha products and services.
 By accessing this Site or placing an order, you agree to these Terms in full. Please review them carefully before proceeding.

1. Company Information

Mécha Atelier LLC is a limited liability company registered in the State of New Jersey, United States of America.
Our fulfillment and production operations are managed through trusted partners and facilities in India, where our garments are handcrafted and shipped to customers worldwide.

2. Acceptance of Terms

By accessing the Site, using its services, or purchasing any product, you acknowledge that you are at least 18 years of age (or the age of majority in your jurisdiction) and have full legal capacity to enter into this agreement.
If you do not agree with any part of these Terms, please discontinue use of the Site immediately.

3. Products, Descriptions & Availability

  • All Mécha garments are handmade and produced in limited quantities.
  • Minor variations in color, texture, or embellishment are natural characteristics of artisanal craftsmanship and shall not constitute defects or grounds for return.
    We make every effort to accurately represent products; however, color or detailing may differ slightly based on screen calibration or device display.
  • Product availability is not guaranteed. We reserve the right to discontinue or modify products at any time without notice.

4. Pricing, Currency & Taxes

  • Prices are displayed in U.S. Dollars (USD) unless stated otherwise.
  • For convenience, local currency conversions may appear, but all payments are processed in USD.
  • Prices exclude import duties, taxes, tariffs, or customs fees, which are the buyer’s responsibility unless specified otherwise at checkout.
  • We reserve the right to change prices, promotions, or discounts at any time without prior notice.

5. Orders & Payments

  • All orders are subject to acceptance and availability. Receipt of an order confirmation does not constitute acceptance.
  • We reserve the right to refuse or cancel orders that appear fraudulent, unauthorized, or in violation of these Terms.
  • Payment is required in full at the time of purchase through approved methods (credit card, debit card, PayPal, Shop Pay, or other platforms integrated at checkout).
  • By submitting payment, you represent that you are the authorized account holder and that the provided information is accurate and complete.

6. Shipping, Fulfillment & Delivery

  • Orders are fulfilled from India and shipped globally via trusted international carriers.
  • Estimated delivery times are provided for guidance only and may vary due to customs, carrier delays, or international logistics.
  • Mécha is not responsible for delays caused by customs clearance, courier backlogs, natural events, or factors beyond our control.
  • The customer is responsible for any customs duties, taxes, or import fees applied by their destination country.
  • Title and risk of loss pass to the buyer once the shipment is handed to the carrier.
  • In the rare event of lost or damaged shipments, we will assist in initiating carrier claims but are not liable for the outcome of such claims.

7. Returns, Exchanges & Refunds

  • Due to the handcrafted nature of our garments, we accept returns only in accordance with our Return Policy.
  • To qualify, returned items must be unworn, unused, unwashed, and in original packaging with all tags attached.
  • Returns must be initiated within 48 hours of delivery and approved by our customer service team prior to shipment back.
  • Return shipping costs and customs fees are the responsibility of the customer.
  • Custom-made, made-to-order, or discounted items are final sale and cannot be returned or exchanged.
  • Mécha reserves the right to deny returns that do not meet the stated conditions.
  • Approved refunds (if applicable) will be processed to the original payment method within 2-3 weeks after inspection.

8. Product Care & Responsibility

Each Mécha piece is designed with care and craftsmanship. Due to delicate embellishments and fine fabrics, garments must be handled gently and cleaned only per provided care instructions.
 Mécha is not liable for damage caused by misuse, mishandling, or improper cleaning.

9. Intellectual Property Rights

All content on the Site—including but not limited to product designs, photography, text, graphics, logos, trademarks, videos, and layout—is owned or licensed by Mécha Atelier LLC and protected under U.S. and international intellectual property laws.
 You may not copy, reproduce, distribute, display, sell, or exploit any content without prior written authorization.

10. User Conduct & Site Use

You agree not to:

  • Use the Site for fraudulent, unlawful, or harmful purposes.
  • Attempt to gain unauthorized access to the Site, servers, or databases.
  • Interfere with the functionality or security of the Site.
  • Upload or transmit any malicious code, malware, or harmful software.

Violation of these Terms may result in immediate termination of access and potential legal action.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Mécha Atelier LLC and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of the Site or products.
  • Our total liability for any claim shall not exceed the purchase price paid for the product in question.
  • Mécha shall not be responsible for any third-party services or content linked from this Site.
  • You assume full responsibility for determining that our products meet your needs before purchase.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mécha Atelier LLC, its affiliates, and employees from and against any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising from your use of the Site, breach of these Terms, or violation of any law or third-party rights.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States of America, without regard to its conflict of law principles.
 All disputes or claims shall be resolved exclusively in the state or federal courts located in New Jersey, USA.

14. Force Majeure

Mécha Atelier LLC shall not be held liable for failure or delay in performance caused by circumstances beyond reasonable control, including but not limited to natural disasters, war, labor disputes, supply chain disruptions, or governmental actions.

15. Privacy & Data Security

We collect and process personal information in accordance with our Privacy Policy.
 By using our Site, you consent to the collection and use of your information as described therein.
 We implement reasonable technical and organizational measures to protect your data, but cannot guarantee absolute security.

16. Changes to Terms

We reserve the right to update or modify these Terms at any time.
 Updates will be effective immediately upon posting to the Site. Continued use of the Site constitutes acceptance of the revised Terms.
